Default Who is at fault?

My co-worker was pulled over in the company van for a local stop of most all vehicles the other day. There was a crazy robbery downtown and they were looking for a dark colored van. The issue is no insurance card was in it, so he was dinged for it by the cop. Is it his fault or our work? Its not his normal vehicle so I don't get it.

I know it seems unfair, but I think he is at fault. He should have checked to make sure he had all he necessary documentation. He wouldn't have left if he did not have gas or if the tires were low. If the law in your state is that you need to have the insurance card, then he should have made sure he had it.

I think he should ask for a hearing in traffic court on this one. It may well be that he is responsible, but a judge may see that there are mitigating circumstances and dismiss the charge.

Of course, there is also the possibility that the judge will say that the driver was not responsible, as you suggest, but that the company was, and therefore the company must pay the fine. It seems to me that the company could save a lot of face by just footing the bill.

I have found out that even though it is a pain in the neck and it takes a day off your life, you should always go to court for most tickets. You can very easily prevent getting points taken off your license and a lot of the times you end up paying lots less than you though. They may even dismiss the ticket.

I would say it is the work's fault. The only way it wouldn't be their fault is if they have you go get the insurance card yourself from the location they keep it in whenever you drive the company car. If they do not make you do that, then it is their fault for not having the info available in the car.
